Toughen Up Digital – Waiver & Disclaimer
Last Updated: April 2025
Thanks for checking out Toughen Up Digital. Before we work together, there are a few important things you should know. This page is here to set expectations clearly and make sure we’re on the same page. I want things to go smoothly, but I also want to be upfront and fair about the risks involved.
I’m Learning As I Go
I’m building websites and online business systems based on what I’ve learned and what I continue to learn. I’m not a certified expert or big agency. I’m doing my best, and I take your project seriously—but I can’t promise perfection. If that’s a dealbreaker, I totally understand and encourage you to work with someone else.
No Guarantees
I can’t guarantee:
• That your site will run perfectly all the time
• That it won’t break after an update
• That you won’t lose data
• That your business will grow or make money
I’ll always do my best to help you get a solid, working product—but websites are complicated, and a lot can go wrong (with plugins, hosting, software updates, or even simple mistakes).
No Liability
If something goes sideways—whether it’s something I did, something I didn’t do, or something totally outside my control—I’m not financially or legally responsible for any damage, loss, or inconvenience. That includes:
• Site outages or broken pages
• Lost sales or traffic
• Hacked or compromised websites
• Hosting failures or plugin bugs
• Changes made by you or someone else with access
This applies to all work: paid, bartered, or favours.
What Happens After You Get Access
In most cases, I’ll give you full access to your site once it’s built. You’re welcome to make changes, but any issues that happen after handoff—whether intentional or accidental—are your responsibility. If I’m managing your site as part of an ongoing service, we’ll clarify what I look after and what you do.
Add-ons & Extras
If you ask for a bunch of extra features or changes beyond what we originally agreed to, I may need to pause, re-quote, or say no. I’m happy to help—but I can’t take on more than what was planned without revisiting the scope of work.
Outside Tools & Services
Many websites rely on third-party services like hosting providers, email systems, plugins, and analytics tools. I don’t control how these platforms work, and I’m not responsible if they cause problems or go down unexpectedly.
Backups & Security
Unless we’ve specifically agreed otherwise, it’s your responsibility to:
• Set up backups through your hosting company
• Keep your login info safe
• Avoid risky plugins or settings after launch
No Legal, Financial, or Marketing Advice
I might give you ideas or suggestions about how to build your site or promote your business—but I’m not a lawyer, accountant, or marketing expert. Always talk to a professional before making big decisions.
I Can Say No
If a project becomes unmanageable, if expectations change dramatically, or if the working relationship isn’t a good fit, I reserve the right to walk away. I’ll always try to communicate respectfully and give you a heads-up if that happens.
Bottom Line
I want to build great stuff and help you succeed—but I need to protect myself from the risks that come with this kind of work. If any of this seems unfair or unclear, let’s talk about it before we begin.
